The Services are powered by Shopify, which provides the ecommerce platform that allows us to sell products and services to you. By accessing or using the Services, you acknowledge that you have read and understood this Privacy Policy.

Nothing in this policy limits any right you may have under applicable Australian privacy legislation.

2. What Is Personal Information?

Under the Privacy Act, personal information means information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether true or not, and whether recorded in a material form or not.

Sensitive information is a subset of personal information and includes health, racial or ethnic origin, religious beliefs, sexual orientation, criminal records, and biometric data. We do not intentionally collect sensitive information unless you voluntarily provide it or we are required to by law.

⚠️ Payment card data is processed securely by third-party payment providers. We do not store, process, or transmit full payment card details on our systems.

  • Browser type, device type, and operating system

  • Log files and session data

  • Pages viewed, links clicked, and navigation behaviour

In accordance with APP 3, we collect personal information only by lawful and fair means, and only where it is reasonably necessary for our functions and activities.

  • Directly from you, when you place an order, create an account, contact us, or subscribe to marketing

  • Automatically, through cookies and tracking technologies when you browse our website (see Section 8)

  • From Shopify, in connection with the operation of our store

  • From third-party partners, such as payment processors, logistics providers, and analytics services, where permitted by law

Where it is reasonable and practicable to do so, we will collect personal information directly from you.

5. Purposes for Which We Use Personal Information

In accordance with APP 6, we use personal information only for the primary purpose for which it was collected, or for a related secondary purpose that you would reasonably expect.

  • Responding to enquiries and support requests

In accordance with APP 6, we only disclose your personal information to third parties in connection with the purposes described in this policy, or where you have consented, or where we are permitted or required by law.

  • Shopify — our ecommerce platform provider, including for their own platform improvement purposes

  • Payment processors (e.g. Stripe, PayPal, Afterpay)

  • Fulfilment, logistics, and shipping providers

  • IT, hosting, and analytics providers

  • Marketing and advertising platforms, where permitted

  • Legal and regulatory authorities, where required by Australian law

All third-party providers are required to handle personal information consistently with the Australian Privacy Principles.

7. Notifiable Data Breaches

We are subject to the Notifiable Data Breaches (NDB) scheme under Part IIIC of the Privacy Act 1988 (Cth).

In the event of an eligible data breach — being unauthorised access to, or disclosure of, personal information that is likely to result in serious harm — we will:

  • Conduct a prompt internal assessment

  • Notify the Office of the Australian Information Commissioner (OAIC) as required by law

  • Notify affected individuals as soon as practicable, where required

In accordance with APP 8, we may disclose personal information to recipients located outside Australia, including service providers in Canada (Shopify) and the United States (payment and marketing platforms). Before doing so, we take reasonable steps to ensure that overseas recipients handle your information in a manner consistent with the APPs.

12. Data Security

In accordance with APP 11, we take reasonable technical and organisational measures to protect personal information from misuse, interference, loss, unauthorised access, modification, and disclosure. No method of transmission over the internet is completely secure, and we cannot guarantee absolute security. In the event of a notifiable data breach, we will act in accordance with Section 7 of this policy.

When personal information is no longer needed, we will take reasonable steps to securely destroy or permanently de-identify it.

13. Data Retention

We retain personal information only for as long as is reasonably necessary to fulfil the purpose for which it was collected, and to comply with applicable legal, regulatory, and accounting obligations. When personal information is no longer required, we will take reasonable steps to securely destroy or permanently de-identify it.

14. Your Privacy Rights (Australian Customers)

a) Right of Access (APP 12) You may request access to the personal information we hold about you. We will respond within 30 days. A reasonable fee may apply to cover the cost of providing access.

b) Right to Correction (APP 13) You may request correction of personal information that is inaccurate, out of date, incomplete, or misleading. We will respond within 30 days.

c) Right to Opt Out of Direct Marketing (APP 7) You may opt out of direct marketing at any time via the unsubscribe link in any marketing email, or by contacting us at support@motocush.com.

Note: Australian privacy law does not currently provide a general statutory right to erasure or data portability equivalent to the GDPR. However, we will consider reasonable requests to de-identify or delete your data where we have no lawful reason to retain it.

15. Privacy Complaints

If you believe we have breached the Australian Privacy Principles or mishandled your personal information, you have the right to complain.

We may update this Privacy Policy from time to time. When we make material changes, we will update the "Last updated" date at the top of this policy and, where appropriate, notify you by email or via a notice on our website. Continued use of the Services after any update constitutes acknowledgment of the revised policy.
